1. Overview
Mobiquity Networks, Inc. (“Mobiquity”) values the privacy of its customers and consumers. Mobiquity’s customers include clients of Mobiquity’s Services (“Services” defined below), third parties (e.g., publishers) that provide data to Mobiquity, as well as brands, advertising agencies, application developers, media and technology platforms, and others who visit any Mobiquity website that links to this policy (“Site”) or otherwise use Mobiquity’s Services (collectively “Customers”). “Consumers” include individuals who use Mobiquity’s applications or who use applications from which Mobiquity receives or collects data (such as applications that are owned and/or operated by Mobiquity’s Customers that utilize Mobiquity’s SDK). Mobiquity provides online and mobile advertising and data Services to our Customers.
This privacy policy (this “Privacy Policy”) explains how we may collect, use, store, and disclose information about Consumers who: (a) visit our website located at www.mobiquitynetworks.com or any other websites on which this Privacy Policy is posted ( “Mobiquity Site” collectively), and (b) utilize a third-party mobile application (“App”) that utilizes the Services.
This Privacy Policy is part of our Terms of Service (http://mobiquitynetworks.com/terms-of-service). By accessing or using the Mobiquity Site or the Services, you agree to this Privacy Policy and our Terms of Service. If you do not agree to every provision of this Privacy Policy and our Terms of Use, you may not access or use the Mobiquity Site or the Services.
This Privacy Policy does not apply to companies that Mobiquity does not own or control, including Mobiquity’s Customers. To learn more about how Mobiquity’s Customers collect, use, and disclose information about consumers, please visit the Customers’ privacy policies.
2. Information Collected from Mobiquity Customers and Consumers on Mobiquity’s Website
Personal Information
To become a Mobiquity Customer, you may be asked to provide certain personal information, including your name, email address, physical address, phone number, and company name. You also may be asked to provide personal information in certain fields on this website. Registration information is used to provide the Services and to send information about the Services.
Web Log Information
When you visit our websites, our servers automatically record certain information in our log files. This web log information includes your IP address, browser type, operating system, the referring web page, pages visited, and cookie information. Like many websites, we use web log information, along with cookies, pixels, and similar technologies, to operate our websites, better understand how they are used, resolve technical problems, and enhance your experience on our sites.
Cookies
Cookies are small files that websites place on your computer as you browse the web. A pixel is a small amount of code on a web page and is often used in connection with cookies. Most web browsers automatically accept cookies. You can instruct your browser, by changing its settings, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit.
Web Beacons
Web beacons are electronic images that may be used on the Mobiquity Site or in emails we send to you. We use web beacons to deliver cookies, count visits, understand usage and effectiveness of offers, and tell whether you open an email and act upon it.
Analytics
Mobiquity works with third-party service providers, such as Google Analytics, which collect information about the use of the Mobiquity Site. These third-party service providers may use tools such as cookies, web beacons, and similar technologies to provide their services. These technologies may be used to assist Mobiquity in offering the Mobiquity Site, such as managing the content on the Site and understanding how Customers and Consumers interact with the Site. Consent
By accessing Mobiquity Site, you consent to the placement of cookies on your Devices and the use of web beacons as described in this Privacy Policy. You may block, delete, or disable cookies or web beacons to the extent permitted by your browsers, applications, and Devices. If you do so, the performance of certain features of the Mobiquity Site may be limited or not to work at all.We may disclose information about Mobiquity Customers and Consumers when necessary to provide the Services to them.
Information Disclosure
Mobiquity may disclose personal information collected on the Mobiquity Site:
- with consent;
- to affiliated companies or joint venture partners;
- to other businesses or persons that help operate or improve Mobiquity’s business;
- if Mobiquity believes that such action is necessary to comply with applicable laws or regulatory investigations, or to respond to a court order, judicial or other government subpoena, warrant, or law enforcement request;
- in the event that Mobiquity is acquired by or merged with a third-party entity or is potentially going to be acquired by or merged with a third-party entity, in any partial or total sale of assets including in the event of bankruptcy, or in any other corporate change, Mobiquity may transfer or assign the information as part of that actual or potential merger, acquisition, sale, or other change of control.
3. Mobiquity Services Description
The Mobiquity Services provide a platform for the collection and use of precise location data, to help advertisers provide more relevant offers to mobile application (“apps”) users and for market research, customer analytics, or analytics of traffic patterns. . Mobiquity is provided precise location data either from the Mobiquity “SDK” installed within partner’s mobile apps, or from a server-to-server transfer with mobile app partners. This location information includes, but is not limited to, lat/long data, (i.e. GPS-level data), and/or WiFi data associated with a mobile advertising ID, such an IDFA or an Android advertising ID and mobile device information like operating system and phone type.
Mobiquity analyses the precise data to make inferences about the types of experiences and or brands a user frequents. For example, we may determine that a user frequents locations associated with sports (e.g., a sports equipment stores and a sports stadiums). These insights are used to place devices into audiences that then allow advertisers to send ads to those particular devices that are on the advertiser’s mobile ad platform. In addition, Mobiquity helps advertisers understand their ad performance by measuring if a Device that saw a particular ad also went to that advertiser’s store location.
4. Information Collection by Mobiquity Services
Customers license our software development kit (“SDK”) or utilize our APIs to access the Services from their apps. Customers may allow us to automatically collect information about your Device. This information is sent to our server through an API in encrypted form, via a HTTPS protocol. Data collection may include:
- Unique Device identifiers for advertising (Google Advertiser ID or IDFA)
- Geolocation and proximity
- IP address
- Time and date
- WiFi networks that have been accessed by device
- Bluetooth BLE signals
- Near field communication (NFC) signals
- Dwell time near points of interest
- Phone make, model and operating system
- Cell phone carrier
- Other non-personally identifiable information as shared by Customer
5. Uses of Information Collected by Mobiquity Services
Mobiquity uses the data collected by the Services utilized by Customers for the following purposes:
- To create location based audiences for use by advertisers
- To predict Consumers’ future interests on a per-Device basis and across Devices
- To determine if a user visited a Customer’s store after seeing a Customers advertising campaign
- To help Customers enhance their profiles and target their advertising
- To offer anonymized and aggregated data to market research, and business intelligence or information products to third parties
- As stated in this Privacy Policy
6. Sharing of Information Collected by Mobiquity Services
Mobiquity may share data collected by the Mobiquity Services:
- With Customers for their advertising, analytics, or other purposes
- With Advertisers to provide location targeted content and advertising
- With third party advertising platforms, such as demand-side, advertising platforms, data management platforms, advertising agency trading desks, proximity solution providers, advertising technology providers, so they may provide location targeted content and advertising
- With third party market research and information companies, to create anonymous data, market research, business intelligence or information products which analyze and monitor aggregated location behavior
- with consent;
- To other businesses or persons that help operate or improve Mobiquity’s business;
- if Mobiquity believes that such action is necessary to comply with applicable laws or regulatory investigations, or to respond to a court order, judicial or other government subpoena, warrant, or law enforcement request;
- In the event that Mobiquity is acquired by or merged with a third-party entity or is potentially going to be acquired by or merged with a third-party entity, in any partial or total sale of assets including in the event of bankruptcy, or in any other corporate change, Mobiquity may transfer or assign the information as part of that actual or potential merger, acquisition, sale, or other change of control.

7. Opt-Out Options and Ad Choices
Opting Out of Interest-Based Advertising
Mobiquity is not currently a member of the Network Advertising Initiative (NAI) and has not been audited by the NAI. Mobiquity does adheres to the NAI Codes of Conduct as described on the NAI website. Mobiquity also adheres to the Digital Advertising Alliance (DAA) Self-Regulatory Principles. For a description of the DAA Program, visit the DAA website. As described above, Mobiquity may use or transfer Device Data that it directly collects or that it receives from Customers, who may use cookies or non-cookie technologies, to enable advertising that is more tailored to Consumers’ inferred interests, preferences, and locations. This practice is known as interest-based advertising. Mobiquity may also collect, use or transfer Device Data collected from one device for interest-based advertising on other devices that may be linked to the device where data was collected. This is known as cross-device linking.
Mobiquity, and our Customers, provide the ability for Consumers to opt out of the collection and use of mobile app data across apps over time on a device, for interest-based advertising purposes, through the DAA’s AppChoices tool. To opt out of Moiquity’s collection, use, and transfer of such app usage data and of Device Geolocation Data, for interest-based advertising purposes, Consumers can download AppChoices onto the relevant mobile device and exercise choice through the app. When such choice is exercised on a device, Mobiquity will also stop using and transferring Device Data from that device for interest-based advertising on other linked devices, and will stop using Device Data from other linked devices for interest-based advertising on the device from which choice was exercised. Please note that Consumers who use more than one mobile device should renew their opt-out choices on each device. Consumers who opt out from use of their Device Data as part of Mobiquity’s Services may continue to receive interest-based advertising from other companies.
Consumers who have downloaded Mobiquity’s Customer’s applications, but who no longer wish to provide information to Mobiquity for interest-based advertising purposes, should opt out through AppChoices as described above.
Opting Out of Interest-Based Advertising by Third Parties on the Mobiquity Site
Mobiquity may permit third parties to collect information on its Site and combine that information with other information collected on non-affiliated websites or applications over time. These third parties may use technologies, including cookies and web beacons, to collect information about Consumers’ or Customers’ use of the Site in order to analyze, report on, or customize content or advertising on the Mobiquity Site or on other sites, or to help us operate and improve the Site. Opting Out of Interest-Based Advertising on Websites by Mobiquity Customers
Mobiquity sometimes works with web-based Customers, such as to coordinate and integrate information across platforms. 8. Data Security, Access and Retention
Mobiquity uses reasonable physical, managerial and technical safeguards to preserve the integrity and security of the collected data. No method of electronic transmission or storage is 100% secure. Therefore, we cannot absolutely guarantee the security of collected data.
Mobiquity respects our Consumer’s wishes to correct, update or integrate inaccurate information where doing so is feasible and non-burdensome. Mobiquity will maintain collected data for as long as unnecessary to achieve our objectives as detailed in this Privacy Policy. In general, Mobiquity stores data for interest based adverting for 90-120 days, at which point the data is retired, though Mobiquity may continue to use that information for analytics purposes and reporting for up to 24 months. We will retain collected data as long as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

- The details of how we secure and manage collected data
- Request the erasure, anonymization or the block of any data collected from your personal devices processed
9. Children’s Privacy
Mobiquity does not knowingly collect data from children under 13 years old or from websites or online services directed to children under 13 years old. In the unlikely event that you are the parent or legal guardian of a child under 13 who has registered with the Site or Services, please contact Mobiquity at [email protected] to have your child’s data deleted.
